PURPOSE OF THE UNIT STANDARD 
This unit standard will be useful for people who are in the military and or who participate in multi-national operations. The law (specifically the Law of Armed Conflict) is an integral part of all multi-national operations, ie conventional war-like operations, peace support operations, internal deployment and peacetime training. In addition to the specific outcomes this unit standard will equip learners to:
  • Make a contribution to the operational planning process.
  • Act within the confines of the law during operations.
  • Timeously address problematic situations at the tactical, operational and strategic levels regarding the application of LOAC.
  • Prevent and suppress violations of the Law of Armed Conflict.

    People credited with this unit standard are able to:
  • Demonstrate knowledge of the basic principles and rules of International Humanitarian law, ie the Law of Armed Conflict (LOAC).
  • Appraise the legal position of the basic categories of persons and objects recognized by the LOAC as well as those persons and objects that are specifically protected by the LOAC.
  • Appraise the legality of the means and methods of warfare during the conduct of operations.
  • Demonstrate knowledge of the LOAC applicable to specific types of operations.
  • Demonstrate knowledge of criminal liability/responsibility under the LOAC.

    Demonstrate knowledge of the basic principles and rules of International Humanitarian law, ie the Law of Armed Conflict (LOAC).

    ASSESSMENT CRITERION 1 
    The nature, status and purpose of LOAC is explained in accordance with reigning international and domestic law. 

    ASSESSMENT CRITERION 2 
    Explanations of reasons for compliance with LOAC are given such that the needs of all interest groups are addressed. 

    ASSESSMENT CRITERION 3 
    The relationship between the LOAC and Human Rights law are compared so that the similarities and differences are identified and explained ito the fundamental protection provided by these two fields of law. 

    ASSESSMENT CRITERION 4 
    The application of the LOAC during armed conflict is explained ito the different types of armed conflict and those bound by the LOAC. 

    ASSESSMENT CRITERION 5 
    The application of the LOAC during armed conflict is explained ito the position of participants and non-participants. 

    ASSESSMENT CRITERION 6 
    The application of the basic LOAC principles are described ito the conduct of operations and the importance of intelligence. 

    SPECIFIC OUTCOME 2 
    Appraise the legal position of the basic categories of persons and objects recognized by the LOAC as well as those persons and objects that are specifically protected by the LOAC.

    ASSESSMENT CRITERION 1 
    The basic categories of persons and objects recognised by the LOAC are explained in terms of their status and protection under the LOAC. 

    ASSESSMENT CRITERION 2 
    The handling of military medical services and religious personnel/objects are explained such that their position under the LOAC is addressed. 

    ASSESSMENT CRITERION 3 
    The legal position of civilian medical services is compared with that of their military counterparts such that the similarities and/or differences are identified and explained ito fundamental protection provided by the LOAC. 

    ASSESSMENT CRITERION 4 
    The protection afforded to specifically protected persons is interpreted ito their rights and obligations under the LOAC during armed conflict. 

    ASSESSMENT CRITERION 5 
    The handling of specifically protected objects during armed conflict is interpreted ito the protection afforded to such objects under the LOAC. 

    ASSESSMENT CRITERION 6 
    Combat actions in/on non-defended localities and demilitarised zones are appraised ito their status as localities and zones under special protection. 

    ASSESSMENT CRITERION 7 
    The conduct of armed forces in occupied territories is assessed in accordance with the rights and obligations of all occupants of such occupied territories. 

    ASSESSMENT CRITERION 8 
    The legal position of neutral states during armed conflict is evaluated in accordance with LOAC requirements pertaining to the maintenance of and respect for their neutral status. 

    ASSESSMENT CRITERION 9 
    Actions of intermediaries/protecting powers are described ito their role and function during armed conflict.

    Appraise the legality of the means and methods of warfare during the conduct of operations.

    ASSESSMENT CRITERION 1 
    The application of the LOAC in naval warfare is assessed to the means and methods of naval warfare, targeting considerations and actions short of naval attack. 

    ASSESSMENT CRITERION 2 
    The application of the LOAC in air warfare is assessed ito the means and methods of air warfare, targeting considerations and international agreements regulating airspace. 

    ASSESSMENT CRITERION 3 
    The application of the LOAC during peace support operations is assessed ito the role and function of peace support forces. 

    ASSESSMENT CRITERION 4 
    Internal operations and non-international armed conflict are explained ito the applicability of the LOAC during these types of situations. 

    SPECIFIC OUTCOME 5 
    Demonstrate knowledge of criminal liability/responsibility under the LOAC.

    ASSESSMENT CRITERION 1 
    Responsibility regarding war crimes and grave breaches of the LOAC is explained ito the obligations placed upon role players at all levels of warfare, ie strategic, operational and tactical. 

    ASSESSMENT CRITERION 2 
    Command responsibility under the LOAC is explained to the prevention and suppression of LOAC violations. 

    ASSESSMENT CRITERION 3 
    The consequences of non-compliance with the LOAC are described to the reigning (international) legal position in determining criminal liability. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • Any institution offering learning that will enable achievement of this unit standard must be accredited as a provider with the relevant ETQA.
  • Anyone assessing a learner against this unit standard must be registered as an assessor with the relevant ETQA.
  • Anyone wishing to be assessed against this unit standard (including RPL) may apply to be assessed by a relevant provider institution, which is accredited by the relevant ETQA.
  • For an applicant to register as an assessor, the applicant needs:
  • Subject matter experience at or above the level of this unit standard.
  • The assessor needs to be competent in the unit standard "Conduct Standard Based Assessment" NQF level 5 and "Design and Develop Assessment Criteria" NQF Level 5.
  • The subject matter experience of the assessor can be established by recognition of prior learning.
  • Moderation of assessment will be overseen by the relevant ETQA according to the moderation guidelines in the relevant qualification and the agreed ETQA procedures.
