PURPOSE OF THE UNIT STANDARD 
This Unit Standard is intended for learners in the Department of Home Affairs who provide operational services relating to refugee reception and status determination. It will be useful for new employees and for employees who are already in service, but do not have formal qualifications and are therefore unable to progress within the Department. It should enable learners to provide efficient services while complying with relevant legislation and regulations.

The qualifying learner is capable of:
  • Identifying the functions of the Department of Home Affairs.
  • Explaining the functions relating to enabling documentation issued by Refugee Affairs.
  • Applying knowledge of South African legislation to issues relating to asylum seekers and refugees.
  • Describing the relationship between the Department of Home Affairs and other stakeholders.

    It is assumed that the learner has the following knowledge and skills:

    The Branches and Chief Directorates of Home Affairs are named and an indication is given of the functions of each.

    Relationships between the different branches are described with reference to combinations of legislation required to offer different services.

    Ways in which Refugee Affairs interacts with the other sections are explained with examples.

    Explain the functions relating to enabling documentation issued by Refugee Affairs.

    The issuing and amendment of Identification Documents and permits are explained with reference to refugees and the consequences of non-compliance with conditions. 

    ASSESSMENT CRITERION 2 
    The issuing of Travel Documents for refugees is explained with reference to requirements for eligibility. 

    ASSESSMENT CRITERION 3 
    Legislation relating to the processing and issuing of enabling documentation is applied to process different types of application. 
    ASSESSMENT CRITERION RANGE 
    Enabling documentation includes ID documents, travel documents and permits.

    Apply knowledge of South African legislation to issues relating to asylum seekers and refugees.

    An own interpretation of the Bill of Rights is applied to explain a decision relating to Refugee Affairs. 

    ASSESSMENT CRITERION 2 
    Conditions that apply to the rights of asylum seekers and refugees are explained with reference to the consequences of non-compliance. 

    ASSESSMENT CRITERION 3 
    The Refugee Act is applied to make a decision regarding asylum. 

    ASSESSMENT CRITERION 4 
    The relationship between the Immigration Act and the Refugee Act is explained with examples. 

    ASSESSMENT CRITERION 5 
    The relationship between the Constitution and the Promotion of Administrative Justice Act is explained with reference to the work of the Department of Home Affairs.

    Describe the relationship between the Department of Home Affairs and other stakeholders.

    Services offered by the Department of Home Affairs to international organisations are explained with reference to the exchange and verification of information and the issuing of documents.

    The relationship between the Department of Home Affairs and the Department of Social Development is explained with reference to minors.
