PURPOSE OF THE UNIT STANDARD 
This This Unit Standard is intended for learners, within the a quality management system, who need to understand how the legal system operates in the country and the broad regulatory framework within which quality management systems operate. While there is a plethora of quality management systems important legislation that is related, this standard only focusses on the few critical ones. Importantly, the learner also begins to appreciate how the legal aspect impacts on our personal understanding of the quality management system.

Learners credited with this standard will be able to:
  • Explain how law works in the country.
  • Explain the main features of legislation pertaining to the QMS environment.
  • Explain other relationship between law and QMS.

    Explain the application of legislation and law.
    Provide a broad overview of how law works in the country. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    The concepts of the state, society and the law and the relationships between them is explained in relation to the Constitution. 

    ASSESSMENT CRITERION 2 
    An explanation is given of how the Constitution of the Republic of South Africa supersedes all other legislation. 

    ASSESSMENT CRITERION 3 
    The structure of the South African Legal System is explained to distinguish the levels within the system and procedures pertaining to each level in the hierarchy. 
    ASSESSMENT CRITERION RANGE 
    The structure includes but is not limited to laws at different spheres (hierarchy), how laws and regulations are drafted, subsidiary law, who administers laws.
     

    SPECIFIC OUTCOME 2 
    Demonstrate an understanding of legislation applicable to the quality management systems environment. 
    OUTCOME RANGE 
    Legislation includes but is not limited to the Occupational Health and Safety Act, Compensation for Occupational and Diseases Act, Skills Development Act, National Environment Management Act, Basic Conditions of Employment Act.

    The relationship of these Acts to the Constitution is explored with a view to seeing how they strengthen and enhance what the Constitution says. 

    ASSESSMENT CRITERION 2 
    The relevant definitions in these Acts are identified and discussed to provide the basis to understand the legislation. 

    ASSESSMENT CRITERION 3 
    The legislative framework within which QM policies are developed and QM activities take place is discussed to ensure compliance to the law. 

    ASSESSMENT CRITERION 4 
    Relevant sections of these Acts are identified and discussed to emphasise their importance and significance in the QMS environment. 

    ASSESSMENT CRITERION 5 
    The relationships and linkages between these Acts are explored and their impact on the QMS environment explained so that a holistic approach to QMS is developed. 

    SPECIFIC OUTCOME 3 
    Demonstrate an understanding of the relationship between legislation and quality management systems standards and conventions.

    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • An individual wishing to be assessed (including through RPL) against this Unit Standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA, or an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Anyone assessing a learner against this Unit Standard must be registered as an assessor with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Any institution offering learning that will enable achievement of this Unit Standard or assessing this Unit Standard must be accredited as a provider with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
