PURPOSE OF THE UNIT STANDARD 
This unit standard is for learners working within a local government structure, who participate in municipal governance and have been elected as municipal councillors, where the acquisition of competence against this standard will add value to one's job and managerial capabilities. The completion of this standard will enable the learner to interpret and analyse the impact of the relevant legislative framework on local government so that all councillor functions are performed according to legislative parameters.

The qualifying learner is capable of:
  • Demonstrating an understanding of the background and founding provision of the Constitution and how this impacts local government.
  • Analysing and interpreting the concept of co-operative government.
  • Identifying and explaining the broad spectrum of municipal and related administrative legislation and regulations that guide and direct the daily functioning of local government.
  • Identifying and explaining the objectives of local government.

    The legislative, executive and judicial structures provided for in the Constitution are explained with examples. 

    ASSESSMENT CRITERION 2 
    The link between the Bill of Rights and Freedom Charter are explained in relation to local government.

    The role of the courts and the administration of justice is explained in the context of a constitutional democracy in South Africa.

    The provisions and arrangements for public administration contained in the Constitution are identified and explained with examples.

    The provisions and arrangement for local government included in the Constitution are identified and explained with examples.

    The provisions include but are not limited to the Constitutional provision for Municipal Financial Management and the functions of local government.

    The role of administrative law in enabling a learner to be a member of a tribunal to hear and decide on matters that affect the internal municipal structures and the public is explained with examples.

    The legislation that is specific to local government is explained in relation to its impact on the functioning of local government. 

    ASSESSMENT CRITERION 4 
    The role of SALGA (SA Local Government Authority) is explained in the context of local government functions and objectives. 

    ASSESSMENT CRITERION 5 
    The appropriate regulatory and statutory stipulations and regulations are applied in order to contribute effectively to the functioning of a municipality.

    The use of the objectives of local government as set out in the Constitution is explained as a basis for service delivery.

    The political structures, its systems and the range of services are identified and related to local government councillor functions.

  • Any individual wishing to be assessed (including through RPL) against this unit standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA, or an ETQA that has a Memorandum of Understanding with the relevant ETQA.
