PURPOSE OF THE UNIT STANDARD 
The person credited with this Unit Standard will have an understanding of Bargaining Council rules and their application and scope.

The qualifying learner will:
  • Understand the purpose and application of Bargaining Council Rules
  • Understand the process for serving and filing the various applications filed in terms of the Bargaining Council Rules as well as other relevant documents
  • Understand the Bargaining Council Rules pertaining to the conciliation and con-arb, arbitration and pre-dismissal arbitration (188A) processes and certification of award(s) (Section 143) 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING

    2. The reasoning behind the Bargaining Council Rules is explained in terms of creating harmony in the labour field and equity for employees. 

    SPECIFIC OUTCOME 2 
    Demonstrate an understanding of the process for serving and filing the various applications filed.

    Demonstrate an understanding of the process for serving and filing the various applications filed in terms of the Bargaining Council Rules and relevant documents.

    Applications refer to condonations, substitution, joinder, variations, rescissions and other premilinary or interlocutory applications.

    1. An explanation is given of the interpretation of proper serving and filing of documents, as set out in the Bargaining Council Rules.

    2. An explanation is given of the calculation of time periods as set out in the Bargaining Council Rules. 

    ASSESSMENT CRITERION 3 
    3. The appropriate process for each type of application, as set out in the Bargaining Council Rules, is described and the applications thereof are listed with examples. 

    SPECIFIC OUTCOME 3 
    Demonstrate an understanding of the Bargaining Council Rules pertaining to the conciliation.

    2. The Bargaining Council Rules pertaining to postponements and subpoenas are described with examples.
