This Unit Standard is for people who are responsible for working with contracts to do with an auction.

The qualifying learner is capable of:
  • Describing elements of a contract.
  • Demonstrating and applying an understanding of fundamental sales law that apply to an auction.
  • Describing the judicial interpretation of the auction contract.
  • Explaining and drawing up contracts between seller, purchaser and auctioneer.

    It is assumed that a learner will be competent in:

    The application of the law of warranties is described with examples.

    The roles and rights of the bidder are explained with examples relating to the making of a bid.

    Reasons why items for sale may be withdrawn by the seller are explained in terms of the reserve process.

    Instances for the withdrawal of the asset by the auctioneer is described in terms of the justification of the withdrawal principle.

    The vendor bid is defined with examples according to national definitions.
