PURPOSE OF THE UNIT STANDARD 
The person credited with this unit standard is able to explain the circumstances under which compensation may be claimed and the nature and degree for which it may awarded. Learners will also be able to explain the investigation process as well the procedures for submission and finalisation of compensation claims. Learners will also be able to complete the Compensation Commissioners documentation and keep records thereof.

The qualifying learner is capable of:
  • Providing an overview of current, relevant legislation pertaining to compensation for occupational injuries and diseases.
  • Describing the compensation procedure for occupational injuries and diseases.
  • Completing Compensation Commissioner documentation for occupational injuries and diseases.

    Provide an overview of current, relevant legislation pertaining to compensation for occupational injuries and diseases. 
    OUTCOME RANGE 
    Legislation may include, but is not limited to, that pertaining to the compensation of occupational injuries and diseases, occupational health and safety for all workplaces and industries, including mines.

    ASSESSMENT CRITERION 1 
    Persons entitled and not entitled to compensation are defined in terms of legislation. 

    ASSESSMENT CRITERION 2 
    Circumstances under which compensation may be claimed are explained in terms of legislation. 

    ASSESSMENT CRITERION 3 
    Nature and degree of disability for which compensation may be awarded are explained in terms of legislation. 

    ASSESSMENT CRITERION 4 
    Knowledge of the compensation benefits that are involved is demonstrated in accordance with legislative requirements. 
    ASSESSMENT CRITERION RANGE 
    Benefits may include but are not limited to earnings, earnings for assessment, temporary disability, permanent disability, compensation for death or injury, control of payment of pension, medical treatment and travelling expenses.
     

    ASSESSMENT CRITERION 5 
    Implications of not adhering to legislative requirements for the compensation of occupational injuries and diseases are described in relation to the impact on both the employer and employee. 
    ASSESSMENT CRITERION RANGE 
    Implications include, but are not limited to, fair industrial relations practices, non acceptance of compensation claims and penalties (fines) to employer.

    Describe the compensation procedure for occupational injuries and diseases.

    ASSESSMENT CRITERION 1 
    Reporting processes of injuries and/or occupational diseases are explained in accordance with legislative requirements. 

    ASSESSMENT CRITERION 2 
    The importance of the investigation process for occupational injuries and diseases is explained in terms of its impact on the awarding of compensation. 

    ASSESSMENT CRITERION 3 
    Demonstrate an understanding of the required claim processes (forms) for submission in accordance with legal requirements. 
    ASSESSMENT CRITERION RANGE 
    Forms must include Employers report, First medical report, Progress report, Final medical report, Appeal system, Specialist report, Resumption form, Medical accounts.
     

    ASSESSMENT CRITERION 4 
    The procedure for dealing with compensation for injuries of persons other than employees is explained in terms of legal prescripts. 

    ASSESSMENT CRITERION 5 
    Control procedures for the finalisation of compensation claims are explained with examples of effective follow-up activities. 

    ASSESSMENT CRITERION 6 
    Knowledge of the employee responsibility is demonstrated in accordance with specific requirements. 
    ASSESSMENT CRITERION RANGE 
    Employee responsibility must include Reporting of the injury/disease, Treatment, Medical benefit examinations, Lung removal at time of death, Safe-keeping of occupational health records for forty years.

    ASSESSMENT CRITERION 1 
    Required documentation for occupational injuries and/or diseases in accordance with legislation is sourced and completed in accordance with legislative requirements. 

    ASSESSMENT CRITERION 2 
    The submission of the Compensation Commissioner documentation is explained in terms of expediting its finalisation and a record thereof is stored. 

    ASSESSMENT CRITERION 3 
    The record keeping system for completed Compensation Commissioner documentation is explained in terms of accessibility, availability and regulatory requirements.

  • An individual wishing to be assessed (including through RPL) against this unit standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA or ETQA that has a Memorandum of Understanding in place with the relevant ETQA.
