PURPOSE OF THE UNIT STANDARD 
The purpose of this unit standard is to enable disciplinary and grievance policy and procedure to be administered. The individual should develop competent usage of the appropriate policy and procedure. The sub-field should develop a standard approach to dealing with disciplinary and grievance issues.

On achievement of this unit standard the learner will understand and be able to:
  • Identify and explain an organisation's policy related to grievance and disciplinary measures.
  • Identify and classify an alleged transgression or grievance.
  • Institute disciplinary procedure relevant to a non-dismissible offence.
  • Institute disciplinary procedure relevant to a dismissible offence.
  • Institute a grievance procedure.
  • Ensure the appropriate procedure is correctly administered.

    On completion of this unit standard the learner should be ready to develop learning in further processes related to disciplinary and grievance measures.

  • UNIT STANDARD RANGE 
    The typical scope and context of this unit standard is the administration of policy and procedure related to dismissible and non-dismissible offences, and any grievance, relevant to any South African workplace.

    SPECIFIC OUTCOME 1 
    Identify and explain an organisation's policy related to grievance and disciplinary measures. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    The relevant policy, whether written or usual practice, is correctly identified, examined using appropriate language and terminology. 

    ASSESSMENT CRITERION 2 
    The relevant policy is explained in a clear manner highlighting the implications of the main elements of the policy. 

    ASSESSMENT CRITERION 3 
    The relationship between the relevant sections of the Labour Relations Act, as well as the Basic Conditions of Employment Act, and the relevant policy. 

    SPECIFIC OUTCOME 2 
    Identify and classify an alleged transgression or grievance. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Appropriate procedure is followed to register or identify an alleged transgression of grievance. 

    ASSESSMENT CRITERION 2 
    A review is conducted of the registration or identification of the alleged activity in order to correctly classify it either as a dismissible offence, a non-dismissible offence or a grievance. 

    ASSESSMENT CRITERION 3 
    Evidence to hand concerning the event, such as witnesses, documentation and physical evidence is considered in order to confirm the classification, according to policy. 

    SPECIFIC OUTCOME 3 
    Institute disciplinary procedure relevant to a non-dismissible offence.

    ASSESSMENT CRITERION 1 
    The alleged transgressor is appropriately informed of the allegation according to company procedure. 

    ASSESSMENT CRITERION 2 
    The alleged transgressor is informed of his/her rights in respect of the process and given access to relevant policy and procedure information in a fair and courteous manner. 

    ASSESSMENT CRITERION 3 
    The process leading up to and during a hearing is correctly outlined, with reference to the role of each of the participants. 

    ASSESSMENT CRITERION 4 
    All potential outcomes of a hearing, including the option of an appeal, are clearly and carefully explained. 

    SPECIFIC OUTCOME 4 
    Institute disciplinary procedure relevant to a dismissible offence.

    An investigation is conducted to gather and maintain evidence relevant to the allegation.

    An appropriate charge is prepared which details the nature of the allegation. 

    ASSESSMENT CRITERION 3 
    The alleged transgressor is appropriately informed of the charge according to company procedure. 

    ASSESSMENT CRITERION 4 
    The alleged transgressor is informed of his/her rights in respect of the process and given access to relevant policy and procedure information in a fair and courteous manner.

    The process to deal with a grievance is instituted with due speed, transparency and fairness.

    Ensure the appropriate procedure is correctly administered.

    ASSESSMENT CRITERION 1 
    Procedure during disciplinary and grievance measures are monitored in an objective and balanced manner. 

    ASSESSMENT CRITERION 2 
    Outcomes of each hearing are appropriately recorded and maintained for future reference. 

    ASSESSMENT CRITERION 3 
    The appeal process is fully adhered to, and the result thereof responded to in accordance with policy and procedure. 

    ASSESSMENT CRITERION 4 
    Proper process is followed, where appropriate, in connection with the Commission for Conciliation, Mediation and Arbitration (CCMA), the Labour Court, or a Bargaining Council.

  • An individual wishing to be assessed against this Unit Standard, including through the Recognition of Prior Learning (RPL), may apply to an assessment agency, assessor or provider institution accredited by the relevant Education and Training Quality Assurance body (ETQA), or one with an appropriate memorandum of understanding (MOU) with the relevant ETQA.
