This Unit Standard requires learners to be able to interpret and apply Safety, Health and Environmental legislation that will enable them to advise management and facilitate measures to ensure legal compliance.

Learners credited with this Unit Standard are capable of:
  • Applying current sections of the Occupational Health and Safety Legislation and relevant subordinate legislation, or the Mine Health and Safety Legislation and relevant subordinate legislation, to the workplace.
  • Applying the principles of common law applicable to safety, health and environment (SHE) in the workplace.
  • Applying the law of evidence and law of civil and criminal procedure in any given case study.
  • Applying the principles of the law of delict and the criminal law relevant to an accident that occurred in the workplace.
  • Applying current sections of the Compensation for Occupational Injuries and Diseases Legislation in the workplace.

    Common law principles applicable to SHE in the workplace are described and motivated. 

    ASSESSMENT CRITERION 2 
    An opinion of the legal position of both employer and employee in a given case study is stated with motivations in terms of the common law principles applicable to SHE in the workplace. 

    SPECIFIC OUTCOME 3 
    Apply the law of evidence and law of civil and criminal procedure in any given case study.

    ASSESSMENT CRITERION 1 
    The relevant rules of the law of evidence and the law of civil and criminal procedure applicable to any given case study are explained. 

    ASSESSMENT CRITERION 2 
    The rules of the law of evidence and the law of civil and criminal procedure are applied in a given case study. 

    SPECIFIC OUTCOME 4 
    Apply the principles of the law of delict and the criminal law relevant to an accident that occurred in the workplace.

    The relevant principles of the law of delict and criminal law are applied to an accident that occurred in the workplace. 

    ASSESSMENT CRITERION 2 
    The criminal and/or civil liability of a negligent party in terms of the principles of the law of delict and/or criminal law are applied in a given case study. 

    ASSESSMENT CRITERION 3 
    The legal position of a negligent party in terms of the principles of the law of delict and the criminal law are applied to an accident that occurred in the workplace. 

    SPECIFIC OUTCOME 5 
    Apply the current sections of the Compensation for Occupational Injuries and Diseases Legislation in the workplace. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    The implementation and enforcement of the current sections of the Compensation for Occupational Injuries and Diseases Legislation and subordinate legislation are discussed with regard to a given workplace situation. 

    ASSESSMENT CRITERION 2 
    The current sections of the Compensation for Occupational Injuries and Diseases Legislation are applied in a given case study.
