PURPOSE OF THE UNIT STANDARD 
The learner credited with this Unit Standard will be able to identify and describe the application of different legislation that impacts on human and workers' rights in South Africa. They will also be able to describe how these are applied in the workplace and the penalty for non-compliance with the legislation.

The qualifying learner will be capable of:
  • Identifying and describing current legislation relevant to workers' rights in South Africa.
  • Explaining how legislation is applied in the workplace.
  • Explaining the impact of labour law in relation to trade unions in the workplace. 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    Learners assessing this Unit Standard will have demonstrated competence in:
  • Communication at NQF Level 3 or equivalent.
  • Mathematical Literacy at NQF Level 3 or equivalent. 

  • UNIT STANDARD RANGE 
    Labour legislation may include but is not limited to Basic Conditions of Employment Act, Employment Equity Act, Skills Development Act, Occupational Health and Safety Act, Labour Relations Act, Compensation for Occupational Injuries and Diseases Act (COIDA), Mines and Safety Act, Public Service Act and Education Employers Act.

    Identify and describe current legislation relevant to workers' rights in South Africa.

    ASSESSMENT CRITERION 1 
    Appropriate sections and chapters of the Constitution of South Africa are identified and described in terms of their impact on workers' rights. 

    ASSESSMENT CRITERION 2 
    Sections of the Basic Conditions of Employment Act are identified and described in terms of their relationship to workers' rights. 

    ASSESSMENT CRITERION 3 
    Sections of the Labour Relations Act are identified and described in terms of their relationship to workers' rights. 

    ASSESSMENT CRITERION 4 
    International Labour standards are identified and compared to labour standards in South Africa in terms of their similarities and differences. 
    ASSESSMENT CRITERION RANGE 
    These should include but not be limited to International Labour Organisation (ILO) Conventions etc.

    Non-legislated rights are identified and described with examples.

    Application of legislation in the working environment is described with examples. 

    ASSESSMENT CRITERION 2 
    Non-compliance to legislation is described in accordance with legislated guidelines. 
    ASSESSMENT CRITERION RANGE 
    This applies to organisations, corporate companies, Non-Governmental Organisations and trade unions amongst others.
     

    ASSESSMENT CRITERION 3 
    Procedures to be followed in the event of non-compliance are explained with examples of how to rectify. 

    SPECIFIC OUTCOME 3 
    Explain the impact of labour law in relation to trade unions in the workplace. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    The role of trade unions in influencing the development of workplace policies is identified and explained according to the principles of governance. 

    ASSESSMENT CRITERION 2 
    Ways to address cases and situations at the workplace that are inconsistent with the implementation of labour legalisation and policy are explained in terms of non-compliance and the impact on the broader legislative framework. 
    ASSESSMENT CRITERION RANGE 
    Legislative framework includes but not limited to redress, equity, gender, basic conditions of employment.
     

    ASSESSMENT CRITERION 3 
    Labour law and workplace policies are analysed in terms of how they improve the working conditions of workers and lead to transformation of the organisation. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • An individual wishing to be assessed (including through RPL) against this Unit Standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA.
  • Anyone assessing a learner against this Unit Standard must be registered as an assessor with the relevant ETQA.
  • Any institution offering learning that will enable achievement of this Unit Standard or assessing this Unit Standard must be accredited as a provider with the relevant ETQA.
  • Moderation of assessment will be conducted by the relevant ETQA at its discretion.
