PURPOSE OF THE UNIT STANDARD 
This unit standard is for persons working in the International Trade environment especially within exports. The learner is able to establish the terms of contracts.

This unit standard is intended for learners who will demonstrate:
  • An ability to acquire a wide range of technical skills.
  • An ability to discuss a considerable choice of procedures.
  • A broad knowledge that incorporates theoretical concepts.
  • An ability to critically analyse information.
  • An ability to make judgements to unknown problems.
  • An ability to work on his/her own with complete responsibility.

    A person credited with this unit standard is able to:
  • Ensure that organisational goals and objectives are adequately catered for in agreements and contracts.
  • Determine the requirements for the various types of contracts and agreements.
  • Interpret customer requirements to conclude legally binding agreements.

    Export contractual requirements are evaluated against organisational export goals and objectives for different export transactions. 

    ASSESSMENT CRITERION 2 
    Standardised contracts for use by the export company are drafted according to organisational policies and procedures relating to different export transactions. 

    ASSESSMENT CRITERION 3 
    Standardised contracts for use by the company are approved according to organisational policies and procedures for different export transactions. 

    SPECIFIC OUTCOME 2 
    Determine the requirements for the various types of contracts and agreements. 
    OUTCOME RANGE 
    Including but not limited to: sales contracts, distribution contracts, agency contracts, royalty agreements, financial contracts, collateral management contracts, tripartite agreements, contracts of carriage, contracts of insurance, service level agreements.

    The importance of contractual terms and conditions is explained as it relates to different export transactions.

    The sellers and buyers needs are for different export transactions.

    The contractual obligations are defined in terms of sellers and buyers needs according to organisational policies and procedures for to different export transactions.

    Interpret customer requirements to conclude legally binding agreements.

    ASSESSMENT CRITERION 1 
    Participating parties' contractual requirements are evaluated according to client's requirements. 

    ASSESSMENT CRITERION 2 
    Participating parties' contractual requirements are communicated to those responsible for establishing contracts in terms of company policies. 

    ASSESSMENT CRITERION 3 
    Draft contract is exchanged and negotiated between participating parties according to organisational policies and procedures for different export transactions. 

    ASSESSMENT CRITERION 4 
    Contracts for the accomplishment of each export transaction are concluded according to organisational policies and procedures for different export transactions. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • Anyone assessing a learner must be registered as an assessor with the relevant ETQA or an ETQA where a Memorandum of Understanding (MOU) exists with the relevant ETQA.
  • Any Institution offering learning that will enable achievement of this Unit Standard must be accredited as a provider through the relevant ETQA or ETQA where a MOU exists with the relevant ETQA.
