PURPOSE OF THE UNIT STANDARD 
This Unit Standard is intended for learners in the insurance organisations who advise on insurance for mining operations, Risk Managers, Managers on mines and learners who advise on operational risk on mines.

The qualifying learner is capable of:
  • Explaining the legislation regulating Health and Safety in a mining environment.
  • Explaining the collective bargaining process required by the Act.
  • Describing how the Act is applied to different mining operations.
  • Applying the risk management process as required by the Act.
  • Explaining the regulations relating to mining closure.

    It is assumed that learners are competent in Communication and Mathematical Literacy at Level 3.

    SPECIFIC OUTCOME 1 
    Explain the legislation regulating Health and Safety in a mining environment. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    The purpose of the Act is explained with reference to the need to regulate the mining industry and the role of the regulations in supporting the Act with reference to the different topics covered in the regulations. 

    ASSESSMENT CRITERION 2 
    The South African Bureau of Standards (SABS) codes and other legislation that apply to mining are named and an indication is given of the locations or areas of operation in the mines where each is applicable. 

    ASSESSMENT CRITERION 3 
    The role of the inspector of mines is explained with reference to the duties and powers of inspectors. 

    SPECIFIC OUTCOME 2 
    Explain the collective bargaining process required by the Act. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    The relationship between Government, Unions and Mine Management is described with reference to regulations in the Act. 

    ASSESSMENT CRITERION 2 
    The process to be followed by mine management in negotiating Health and Safety agreements with labour is explained and an indication is given of the consequences for all parties in the event of non-compliance. 

    ASSESSMENT CRITERION 3 
    The need for the healthcare requirements of the Act are explained in terms of the collective bargaining requirement. 

    SPECIFIC OUTCOME 3 
    Describe how the Act is applied to different mining operations.

    ASSESSMENT CRITERION 1 
    The basic principles of mining are explained with examples. 

    ASSESSMENT CRITERION 2 
    The concept of surface mining is explained with reference to quarrying and open cast mines. 

    ASSESSMENT CRITERION 3 
    The concept of underground mining is explained with reference to fiery and non-fiery mines. 

    ASSESSMENT CRITERION 4 
    Operations on a mine are classified in terms of surface and underground works and an indication is given of legislation that applies to each type of operation. 

    SPECIFIC OUTCOME 4 
    Apply the risk management process as required by the Act. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    Potential hazards in the workplace are surveyed and safety, health and hygiene risks are identified and evaluated in terms of probability and severity of impact on the mining operation. 

    ASSESSMENT CRITERION 2 
    Records required by the Act are named and an indication is given of why each is necessary and the regulatory retention period. 

    ASSESSMENT CRITERION 3 
    Appointments specified in the Act are identified and explained in terms of the functions of each. 

    ASSESSMENT CRITERION 4 
    The concepts of perils, hazards and exposure are explained with examples. 

    ASSESSMENT CRITERION 5 
    A report on the existing situation in a mining operation is compiled and recommendations are made to address areas of non-compliance. 

    SPECIFIC OUTCOME 5 
    Explain the regulations relating to mine closure. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    The requirements of the Act are analysed and a policy is developed to manage mine closure. 

    ASSESSMENT CRITERION 2 
    A plan to rehabilitate surface and workings areas is compiled with reference to safety, health, environs and the surroundings of the mine. 

    ASSESSMENT CRITERION 3 
    On going support functions after closure are named and an indication is given of the consequences if these are monitored regularly.

  • Anyone assessing a candidate against this Unit Standard must be registered as an assessor with the relevant ETQA or ETQA where a Memorandum of Understanding (MOU) exists with the relevant ETQA.
  • Any institution offering learning that will enable achievement of this Unit Standard must be accredited as a provider through the relevant ETQA or ETQA where a Memorandum of Understanding (MOU) exists with the relevant ETQA.
  • Moderation of assessment will be overseen by the relevant ETQA according to the moderation guidelines and the agreed ETQA procedures.
