PURPOSE OF THE UNIT STANDARD 
This unit standard will enable court-based learners to utilise domestic violence applications and to process these efficiently, thereby improving the response of the justice system to domestic violence and contributing to the protection of vulnerable members of South African society.

Learners credited with this unit standard will be able to:
  • Utilise applications for protection orders.
  • Utilise applications to oppose protection orders.
  • Utilise applications to set aside or vary protection orders.
  • Process domestic violence applications.

    UNIT STANDARD RANGE 
    This unit standard includes all domestic violence applications utilised by court-based staff in terms of sections 4 and 10 of the Domestic Violence Act no 116 of 1998.

    Contents of the affidavit that should accompany applications to set aside or vary protection orders are analysed to inform court users.

    Applicants in domestic violence matters are scheduled to appear before a magistrate in the context of a given case study. 

    ASSESSMENT CRITERION 4 
    The appearance of both parties in court on return dates is scheduled by way of role play.

  • An individual wishing to be assessed (including through RPL) against this Unit Standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA, or an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Anyone assessing a learner against this Unit Standard must be registered as an assessor with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
