PURPOSE OF THE UNIT STANDARD 
This unit standard will enable court based learners to gain the necessary knowledge and skills to provide guidance to inter-sectoral service providers and court users and to facilitate fair and equitable court decisions in children's court matters.

Learners credited with this unit standard will be able to:
  • Provide information on children's court issues and procedures.
  • Guide people on the interventions available in children's court matters.
  • Draft documentation for placements and adoptions.
  • Draft other children's court documents.

    UNIT STANDARD RANGE 
    The children's court documents to be covered in this unit standard are those prescribed by the regulations made in terms of section 60 of the Child Care Act no 74 of 1983. 

    Specific Outcomes and Assessment Criteria: 

    SPECIFIC OUTCOME 1 
    Provide information on children's court issues and procedures.

    ASSESSMENT CRITERION 1 
    Powers and functions of the children's court are examined in order to inform service providers and court users. 

    ASSESSMENT CRITERION 2 
    Impact on parental rights and responsibilities is defined in the context of children's court matters. 

    ASSESSMENT CRITERION 3 
    Procedures to be followed in adoption matters are explained to service providers in the context of the Child Care Act. 

    ASSESSMENT CRITERION 4 
    Procedures to be followed in the placement of children are explained to service providers in the context of the Child Care Act. 

    ASSESSMENT CRITERION 5 
    Procedures followed at a children's court enquiry and what will be expected of parties before, during and after the proceedings are explained in order to inform court users. 

    SPECIFIC OUTCOME 2 
    Guide people on the interventions available in children's court matters. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Information from service providers is extracted in order to determine whether a child may be in need of care and protection. 
    ASSESSMENT CRITERION RANGE 
    The types of information to be covered are set out in section 14(4) of the Child Care Act no 74 of 1983.
     

    ASSESSMENT CRITERION 2 
    Factual children's court matters are analysed and service providers assisted to identify interventions for vulnerable children. 
    ASSESSMENT CRITERION RANGE 
    Interventions must cover adoption, parental care, residential care, and the different categories of alternative care.
     

    ASSESSMENT CRITERION 3 
    The role and purpose of reports that are ordered by the children's court are examined in order to inform service providers.

    Draft documentation for placements and adoptions.

    The documents to be covered are forms 2, 4, 5, 8, 10, 11, 12, 14, 20, 21 and 24 used by the children's court.

    Forms used in the children's court system for placements and adoptions are explained in terms of their purpose. 

    ASSESSMENT CRITERION 2 
    Factual children's court matters are analysed in order to identify the necessary course of action.

    Children's court forms for placements and adoptions are completed in terms of the Child Care Act. 

    ASSESSMENT CRITERION 4 
    Factual children's court matters are analysed in order to identify outstanding documentation or information from service providers.

    Draft other children's court documents. 
    OUTCOME RANGE 
    The documents to be covered are forms 1, 1A, 3, 4A, 6, 16, 17, 17A, 18, and 19 used by the children's court.

    Forms for securing the attendance of parties at enquiries and administering contribution orders are identified in the context of the Child Care Act.

    Factual children's court matters are analysed in order to identify the legal course of action.

    Forms for securing the attendance of parties at enquiries and administering contribution orders are drafted in the context of the Child Care Act. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • An individual wishing to be assessed (including through RPL) against this Unit Standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA, or an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Anyone assessing a learner against this Unit Standard must be registered as an assessor with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
