PURPOSE OF THE UNIT STANDARD 
This unit standard is intended for government staff at all levels that has to ensure compliance with labour legislation.

The qualifying learner is capable of :
  • Identifying and accessing legislation, legal documents and regulations.
  • Interpreting legislation, legal documents and rules and regulations.
  • Providing advice on compliance with legislation and regulations which regulate business in general and the department/division in particular.
  • Identifying areas of non-compliance with legislation.
  • Take appropriate corrective actions.

    Legal, statutory requirements in terms of the different labour legislation are identified for later use.

    The implications of compliance and non-compliance are understood and an explanation of the advantages and disadvantages of each are given with examples.

    Conduct an audit to determine compliance with labour legislation and regulations.

    Audit is conducted in line with departmental procedures and guidelines.

    Verify that legal documentation used is verified for correctness, currency, appropriateness and compliance with legal and statutory requirements.

    Terminology used in all documents, contracts and transactions is verified for accuracy accurate and clarity.

    Reporting systems are verified to be in place according to the requirements.

    Compliance issues are communicated to all stakeholders.

    Possible areas where non-compliance is possible for the section/division/department are identified for possible corrective action.

    Identified areas are examined to determine if there is compliance or non-compliance.

    Appropriate corrective action is listed for areas where non-compliance is identified or where compliance could be closer to the letter of the law.

    A report on non-compliance/compliance with applicable legislation is submitted to management for consideration.
