PURPOSE OF THE UNIT STANDARD 
A person credited with this Unit Standard is able to demonstrate an understanding of the various Acts relating to Human Resource Development in South Africa, highlighting the transformative nature of the legislation, and identifying parts of the legal framework which is intended to bring about transformation in the country.

In particular, on completion of this Unit Standard, the learner is able to:
  • Discuss the Human Resources Development legislation in terms of the history of the country
  • Understand how the Human Resources Development legislation needs to be used to transform the education and training terrain
  • Integrate the SAQA and Skills Development legislation
  • Recognise that the Employment Equity Act is an integral part of the Human Resources Development strategy
  • Affect transformation through the application of the Human Resources Development legislation
  • Relate the learning gained in achieving this Unit Standard to Organisational Transformation and Change Management (OT&CM)

    A presentation on the flexibility of the National Qualifications Framework, allowing it to combine different learning areas, is illustrated using examples.

    A presentation outlining how the SAQA Act empowers the learner and encourages lifelong learning is given using appropriate aids, language and terminology.

    Six knowledge areas within the same workplace are outlined, in writing, in terms of knowledge production and learning requirements. 

    ASSESSMENT CRITERION 4 
    Learnerships and why they are necessary are explained in a presentation. 

    SPECIFIC OUTCOME 3 
    Demonstrate why the Skills Development Levies Act (SDLA) is much more than just a tax.

    A presentation outlining the purpose of the Skills Development Levy is clearly presented to a group of managers. 

    ASSESSMENT CRITERION 2 
    A document is circulated outlining what can be achieved within a company as part of the required processes to claim a refund of the levies, and other potential claims in terms of the legislation. 

    SPECIFIC OUTCOME 4 
    Analyse the features of the Employment Equity Act (EEA) with regard to transformation in South Africa. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    The major features of the Employment Equity Act are outlined in writing. 

    ASSESSMENT CRITERION 2 
    The reasoning behind the Employment Equity Act is explained to a group of managers. 

    ASSESSMENT CRITERION 3 
    A document is circulated outlining Employment Equity as a business imperative for any company or organisation operating in South Africa. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
    Accreditation for this Unit Standard shall be obtained from the relevant Education and Training Quality Assurance Body, through summative and formative assessment by a registered assessor.
  • Assessors must be registered as an Assessor with the relevant ETQA, or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Moderators must be registered as assessors with the relevant ETQA, or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Training providers must be accredited by the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.

    Moderation should include both internal and external moderation where applicable.
