Registered-data under construction

The qualification content is currently being updated for the qualifications with the status “Registered-data under construction” or showing “DETAILS UNDER CONSTRUCTION” to ensure compliance with SAQA’S Policy and Criteria for the registration of qualifications and part-qualifications on the National Qualifications Framework (NQF) (As amended, 2022). These qualifications are re-registered until 30 June 2027 and can legitimately be offered by the institutions to which they are registered.

 

In all of the tables in this document, both the pre-2009 NQF Level and the NQF Level is shown. In the text (purpose statements, qualification rules, etc), any references to NQF Levels are to the pre-2009 levels unless specifically stated otherwise.  

PURPOSE AND RATIONALE OF THE QUALIFICATION 
This qualification includes the various specialisations in Law. Please refer to "Notes" for details on the specialisations.

To offer a Masters Degree in Law, following upon the Bachelor of Law Degree or a qualification(s) deemed to be its equivalent for this purpose, allowing for (a) specialised coursework teaching and (b) specialised research towards a dissertation, both aimed at the enhancement of legal academic and legal professional skills.

Since the new four-year Bachelor of Law qualification has been "demoted" from Postgraduate (i.e. a minimum of five years of study) to undergraduate studies, the qualification has had to assume a new responsibility, viz of providing Bachelor of Law learners with the necessary opportunity for adding to their prior graduate-level knowledge, enlarging their skills base for rendering a variety of public and private legal services. 

LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
Recognition of Prior Learning (RPL):
The institution conducts RPL in terms of the policy and guidelines of the institution to recognise other forms of formal, informal and non-formal learning and experience. In cases where learners do not comply with the formal admission requirements, the institution applies its RPL policy.

Entry requirements:
The minimum entry requirement for this qualification is:
  • Bachelor of Laws, NQF Level 8.
  • Postgraduate Diploma in Mercantile Law, NQF Level 8.

    Integrated assessment:
    Tests, assignments and examinations are utilised for coursework. Internal and external assessors are employed in the case of both qualifications by coursework and dissertation.

    ARTICULATION OPTIONS 
    This qualification offers both possibilities of horizontal and vertical articulation.

  • Master of Laws in Constitutional Theory, Law and Litigation, Level 9.

    Vertical Articulation:
  • Doctor of Laws in Mercantile Law, Level 10.
