PURPOSE AND RATIONALE OF THE QUALIFICATION

To offer a general masters degree in law, following upon the LLB degree or a legal or non-legal qualifications deemed to be its equivalent for the purpose, allowing for specialised coursework teaching and/or specialised research towards a dissertation in both cases aimed at the enhancement of academics and professional skills of a legal and/or interdisciplinary nature.

4. A research proposal developed and presented independently.

5. Knowledge and generic research skills are expressed in Law in an integrated, logical and coherent manner through written assignments

6. Abstract thoughts are expressed in a logical and coherent way

7. Delimitation, literature searches, logical analysis, balanced interpretation, structuring and expressing is conducted through consistent use of a system of references.

Integrated assessment appropriately incorporated to ensure that the purpose of the qualification is achieved:

Tests, assignments and examinations are utilised in the case of M Phil by coursework. Internal and external assessors are employed in the case of both M Phil by coursework and M Phil by dissertation.

ARTICULATION OPTIONS

Horizontally, all courses passed towards the M Phil degree may be used as credits for the LLM degree or the Post Graduate Diploma in Law upon converting from the former to either of the latter. Vertically, PhD studies may follow upon completion of the M Phil degree.

MODERATION OPTIONS

External moderation of the course in the final years, and assessment of student progress will done by external moderators appointed by the Department on an annual basis and approved by Senate. Internal moderation will occur through the Department. The moderation body is the Council for Higher Education.

CRITERIA FOR THE REGISTRATION OF ASSESSORS

The current senior lecturing staff of the Faculty of Law, the majority of whom hold doctors/masters degrees in law, will continue to act as internal assessors. External assessors will continue to be selected senior colleagues from the other SA universities specialising in the field concerned, as a general rule also holding doctors/masters degrees.
