The qualification content is currently being updated for the qualifications with the status “Registered-data under construction” or showing “DETAILS UNDER CONSTRUCTION” to ensure compliance with SAQA’S Policy and Criteria for the registration of qualifications and part-qualifications on the National Qualifications Framework (NQF) (As amended, 2022). These qualifications are re-registered until 30 June 2027 and can legitimately be offered by the institutions to which they are registered.

 

In all of the tables in this document, both the pre-2009 NQF Level and the NQF Level is shown. In the text (purpose statements, qualification rules, etc), any references to NQF Levels are to the pre-2009 levels unless specifically stated otherwise.  

PURPOSE AND RATIONALE OF THE QUALIFICATION 
First, qualifying learners acquire knowledge and understanding of: the basic concepts, structure and history of the South African legal system and of the main branches of private law. Secondly, learners acquire a basic knowledge and understanding of key aspects of Economic and Business Sciences. This twofold purpose has the primary function of equipping learners with: basic and essential knowledge of Law and Economic and Business Sciences; an invaluable applied competence acquired in the study of Law and Economic and Business Sciences, to enable them to engage in a concerted study of law for the LLB qualification. The learner is thereby prepared for a process of further learning in Law, leading to a deeper understanding of the nature and function of, and an ability to apply, the law in the regulation of commercial activity. 

LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
Recognition Of Prior Learning:
Recognition of Prior Learning in the case of learners not complying with the formal entry requirements will be conducted in accordance with the policy and guidelines of the University concerning the recognition of other forms of formal, informal and non-formal learning and experience. Recognition takes place only where prior learning corresponds to the required NQF-level, and in terms of applied competencies relevant to the content and outcomes of the qualification. Through Recognition of Prior Learning learners may gain: access, advanced placement, or recognition of status, on condition that they may continue their studies at this University.

Recognition takes place in terms of requirements and procedures applied by the Faculty of Economic and Management Sciences in consultation with the Faculty of Law. This may include admission on the strength of psychometric evaluation conducted by the University.

Entry Requirements:
The minimum entry requirement for this qualification is:
  • National Senior Certificate, NQF Level 4, granting access to Bachelor's studies.

    1. Identify, analyse, reflect on and solve legal problems, as well as problems in the fields of Economic and Business Sciences, responsibly and creatively, at a basic level, based on their basic knowledge and understanding of the relevant fields of study.
    2. Function effectively within a multidisciplinary team or organisation, to enhance awareness of the necessity of teamwork and reflect on their own functioning in a team.
    3. Organise and manage themselves and their activities as law practitioners responsibly and effectively. Reflect on their own abilities to organise and manage themselves and their activities.
    4. Do basic research in the fields of Law and Economic and Business Sciences; and reflect on the research.
    5. Communicate, both orally and in writing, to enable the effective practice of the law. Through their knowledge and understanding of Law and Economic and Business Sciences and their ability to apply their knowledge and understanding in real-life situations, learners should demonstrate an ability to communicate effectively, which will enhance their self-confidence. Reflect on their communication ability.
    6. Utilise science and technology with sensitivity to address environmental needs effectively through study and research. Reflect on the acquired skills.
    7. Demonstrate an enhanced insight into the interrelatedness of: Law, Economic and Business Sciences and society in general; as well as the influence of the law on economic activity and vice versa.
    8. Develop learning skills through the multidisciplinary character of the qualification. Reflect on the acquired skills.
    9. Display an understanding, awareness and knowledge of commercial and business issues and processes. Develop social responsibility as citizens.
    10. Develop an awareness and sensitivity for social realities through the combined studies of Law and Economic and Business Sciences.

    Formative assessment practices that will be implemented:
    Formative assessment is aimed at the development of a life-long learning culture based on continuous self-study and comprises the following: In every semester module, learners write two formal written tests. In every year module, learners write four formal written tests. Written assignments on set topics are completed by learners in most modules. Peer and self-assessment are encouraged through group discussions, class tests, and questions included in study material.

    Summative assessment practices that will be implemented:
    Integrated assessment, focusing on the achievement of the exit-level outcomes, will be done by means of formative assessment. The summative assessment determines whether the learners are awarded the qualification. In the summative assessment, learners are assessed by means of a written examination at the end of each module on the study material covered in the module.

    This qualification allows possibilities for both vertical and horizontal articulation.

  • Bachelor of Commerce Honours, NQF Level 8.

    Horizontal Articulation:
