| PURPOSE AND RATIONALE OF THE QUALIFICATION |
| The essential purpose of this qualification is to equip legal practitioners with expert and advanced knowledge of deeper insight into and practical skills relating to the South African Company Law.
A further purpose is to enable students to contribute and play a part in the national pursuit of expertise in the area of company law |

| Senior Certificate with Matriculation Exemption or equivalent university admission qualification.
First degrees: LLB or BProc degree. Other qualifications: Bachelor's degree in Law with academic or professional experience that has been accepted by the Senate as sufficient for the purpose of this qualification. Specific additional requirements: Attorneys or candidate attorneys will be admitted. |

| The post-graduate diploma in Company Law will equip the student with:
a) Expert and advanced knowledge of South African Company Law; b) An understanding of the legal aspects relating to the representation of a company, division of powers between shareholders and directors, organs and their relative powers, shares, dividends and capital maintenance, re-organisation and winding-up, financial statements; c) In-depth understanding of the particular problems involving closed corporations. d) Insight into the relevance of proposed solutions. The student will demonstrate: e) The ability to interpret and practically apply the legislation relating to Companies. |
| ASSOCIATED ASSESSMENT CRITERIA |
| a) A written examination assesses the student's knowledge of the contents after each module has been completed;
b) and (c) Problem-type questions set in written examinations and assignments assess the student's ability to identify legal issues and apply theoretical principles to practical problems; d) Insight into the relevance of proposed solutions is assessed by problem-type questions posed in examinations and assignments. Integrated assessment: An assignment has to be completed each semester and after the completion of each module the students will undergo a written examination. |
