PURPOSE AND RATIONALE OF THE QUALIFICATION

1. Equip the learner with an enhanced knowledge of the legal principles governing the employer, employee and labour management relationship

2. Equip the learner with advanced legal research skills in labour law and associated social security law.

3. Equip the learner with the analytical and interpretative competencies in the application and understanding of labour law and social security law in the work and social environments.

4. Equip the learner to pursue and acquire post-graduate multi-disciplinary learning in the areas of labour and social security law

5. Afford the learner the opportunity to acquire the necessary entrepreneurial skills in labour and social security law.

6. To provide the community with high level specialists who are able to make a substantial contribution towards the understanding of legal principles underlying the employment relationship and social protection.

7. To contribute towards redressing irregularities in the employment and social field and to stimulate policy development and debate.

ASSOCIATED ASSESSMENT CRITERIA

A comprehensive range of assessment criteria will be used to determine learner achievement. The overall criteria will include, but will not be limited to:

1. Defining a particular topic/problem

2. Drawing relevant comparisons between South African and foreign International law

3. Revealing an ability to distil moral and cultural values underlying related economic and employment realities in society

4. Debating the impact on society in general and on certain interested groups in particular of related labour law provisions and principles governing employment situations

5. Undertaking independent research and writing at an advanced level.

INTEGRATED ASSESSMENT

Formative assessment is conducted by class discussions, assignments and the writing of a dissertation. Discussion of assignment and examination results and other forms of feedback, take place on a regular and continuous basis and are an integral and critical part of assessment

In the summative assessment the four modular examinations and the final dissertation as submitted are examined by a panel of not less than two examiners. The qualification is obtained if the learner passes all four modular examinations and the dissertation.

CRITERIA FOR THE REGISTRATION OF ASSESSORS

Internal assessors will be academics from the Faculty of Law selected on the basis of their recognised expertise in the modules being examined.
External assessors will comprise of academics from Faculties of Law at other universities and professionals selected on the basis of their recognised expertise in the modules being examined
