PURPOSE AND RATIONALE OF THE QUALIFICATION 
Purpose:
The Labour Inspector promotes, monitors and enforces compliance within the employment legislative framework.

A qualified learner will be able to:
  • Monitor and enforce relevant legislation.
  • Facilitate fair and just labour relations.
  • Initiate actions to prevent labour disputes.
  • Promote, monitor, and enforce compliance with collective agreements.

    Rationale:
    With the advent of democratic government in South Africa in 1994, an entirely new approach to Labour Inspections in South Africa has emerged. There has been the establishment of new statutory structures with implications for every level of labour relations in the country. The purpose is to advance economic development and social justice, reduce labour unrest and advance the democratisation of the workplace by fulfilling the primary objective of labour-related legislation. This qualification will help to transform the labour market and workplace by promoting sound and improved employment relationships.

    The qualification will provide learners with specific learning and skills related to compliance with statutory and legislative frameworks in the workplace. This qualification will deepen learners' understanding of the South African Labour Relations field and will underpin their ability to use this qualification in various workplaces. The development of competence in this field can lead to better service delivery, institutional longevity and the promotion of job creation and security. Labour inspection will help prevent costs resulting from occupational accidents and illnesses, absenteeism, abuse of workers and labour conflict. Application of the learning in this qualification will also assist parties in labour disputes to enforce their labour rights while at the same time, enabling them to become aware of their obligations as active and responsible participants in society and the economy. Therefore, this qualification is designed to enable individuals to develop theoretical competencies, practical skills, and work experience to operate effectively in the labour relations field.

    The qualification will be targeting school leavers, graduates and currently employed persons in organisations such as the Commission for Conciliation, Mediation and Arbitration (CCMA), the Department of Labour, Human Resource (HR) Practitioners, Labour consultants, Bargaining and statutory councils, Private agencies, Advice offices, Law firms, particularly labour lawyers, Trade unions and federations, and Employer organisations and federations. The successful implementation of this qualification will support the strategic and socio-economic objectives of the country.

    Recognition of Prior Learning (RPL):
    RPL for Access to the External Integrated Summative Assessment
    Accredited providers and approved workplaces must apply the internal assessment criteria specified in the related curriculum document to establish and confirm prior learning. Accredited providers and workplaces must confirm prior learning by issuing a statement of results or by certifying a work experience record.

    Associated Assessment Criteria for Exit Level Outcome 1:
  • Compile plans for inspection visits.
  • Conduct preparation for inspection visits at business premises.
  • Conduct inspections of employer records and business premises.
  • Confirm compliance status, and follow-up action agreed upon.
  • Institute the enforcement process for non-compliance.

    Associated Assessment Criteria for Exit Level Outcome 2:
  • Gather specific information relating to own labour jurisdiction.
  • Research and establish a structured advocacy approach within own labour jurisdiction.
  • Optimise the advocacy opportunity.

    Associated Assessment Criteria for Exit Level Outcome 3:
  • Consolidate and analyse labour trends and statistics.
  • Share information and create awareness to prevent labour disputes.
  • The support of employers, workers and their organisations and other relevant organisations for implementing the highest standards of ethics in the labour inspection services and the profession are actively sought.

    Associated Assessment Criteria for Exit Level Outcome 4:
  • Interpret collective agreements, and capture data components.
  • Present and report analysis.
  • Consolidate and share policy and practice variances within own labour jurisdiction.

    Integrated Assessment:
    Integrated Formative Assessment
    The Skills Development Providers will use the curriculum to guide them on the stipulated internal assessment criteria and weighting. They will also apply the scope of practical skills and applied knowledge as stipulated by the internal assessment criteria. This formative assessment leads to entrance into the integrated External Summative Assessment.

    Integrated Summative Assessment
    An External Integrated Summative Assessment, conducted through the relevant QCTO Assessment Quality Partner is required to issue this qualification. The External Integrated Summative Assessment will focus on the Exit Level Outcomes and Associated Assessment Criteria. 

  • INTERNATIONAL COMPARABILITY 
    The international comparability study conducted focused specifically on identifying occupational standards or qualifications used in other countries that might contain indicators of best practice that could be used for comparison in the development of the Labour Inspector qualification.

    Japan, the United States of America (USA) and the United Kingdom (UK) were selected as a best practice as it was accepted as international standards.

    Japan International Labour Foundation offers training on Labour-related legislation and social security in Japan, also Industrial Relations.

    USA
    Cornell University - Industrial and Labour Relations (ILR) School provides training in Labour-Management Cooperation; Legal Issues; Collective Bargaining.

    United Kingdom
    Central London - Employee Relations, Trade Unions and the Law trains learners in Training and Development; Employee Relations; European Union

    The content, scope and duration of the qualification is uniform internationally and has been controlled against the ILO Conventions for Labour Inspectors and the national statutory and legislative framework.

    Conclusion
    South African standards are equal to other countries as South Africa adheres to the International Labour Organisation's conventions and regulatory requirements. The standards are comparable with those for labour inspectors in countries having comparable education and training systems to South Africa.
