    The relationship between the given sector and the specific industry is explained in terms of structure and governing legislation.

    The legislative framework applicable to the specific sector is explained in terms of its impact on employees for the specific occupation. 
    ASSESSMENT CRITERION RANGE 
    Legislative framework may include but is not limited to:
  • Basic rights of an employee contained in the Basic Conditions of Employment Act as they affect employees for the specific occupation.
  • The basic duties of an employer contained in the Basic Conditions of Employment Act.
  • Basic rights of an employee in the Labour Relations Act in relation to:
    > Freedom of Association.
    > Bargaining.
    > Unfair Labour Practice.
    > Unfair Dismissal.
  • Role of the Department of Labour.
  • Role of the Commission for Conciliation, Mediation and Arbitration (CCMA) or Bargaining Council (where applicable).

    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • Anyone assessing a learner or moderating the assessment of a learner against this unit standard must be registered as an assessor with the relevant ETQA in accordance with the current ETQA regulations.
  • Any institution offering learning that will enable the achievement of this unit standard must be accredited as a provider with the relevant ETQA.
