PURPOSE OF THE UNIT STANDARD 
This Unit Standard will provide members of a School Governing Body (SGB) with the legal knowledge, processes and procedures relating to construction projects, maintenance and letting and correctly administering movable and immovable property of the school.

Learners credited with this Unit Standard will be capable of:
  • Explaining the legal framework within which schools occupy and administer school grounds and buildings.
  • Maintaining school buildings.
  • Letting buildings and land.
  • Applying knowledge of the procurement and administration of movable and immovable assets in a school.

    SPECIFIC OUTCOME 1 
    Explain the legal framework within which schools occupy and administer school grounds and buildings. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    The rights, functions and obligations with regard to immovable property given to SGBs are explained in terms of the SASA. 
    ASSESSMENT CRITERION RANGE 
    Immovable property refers to State land, private land, departmental usage, custodian department [in terms of Government Immovable Asset Management Act (19/2007) [GIAMA], the SASA Sections 13, 14, 16, 20(1)(g); 20(2), 21(1)(a), 37(2)&(6), 42, 59 & 60(4)&(5).
     

    ASSESSMENT CRITERION 2 
    The impact of other legislation on the administration of school grounds and buildings is explained in order to gain a comprehensive understanding of the administration process. 
    ASSESSMENT CRITERION RANGE 
    Occupational Health & Safety Act [85/93], National Building Regulations & Building Standards Act [49/95], Rental Housing Act [50/99], Government Immovable Asset Management Act [19/2007], Prevention of Illegal Eviction from and Unlawful Occupation of Land Act, [19/99], Extension of security of tenure Act, [62/97], Control of Access to Public Premises and Vehicles Act, [53/1985], provincial Acts and policies.
     

    ASSESSMENT CRITERION 3 
    The different tender and procurement procedures with regard to a school context are explained in relation to financial and administrative accountability. 
    ASSESSMENT CRITERION NOTES 
    Procurement procedures refer to categories of tenders, Tender Regulations, the SASA [auditing], and provincial policies.

    Maintain school buildings.

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Provincial policies with regard to maintenance of buildings and grounds are explained to aid the school's compliance with them. 
    ASSESSMENT CRITERION NOTES 
    Compliance in terms of the SASA, Norms and Standards for Funding. 

    ASSESSMENT CRITERION 2 
    The different types of maintenance are identified and the required legislative procedure for each is explained. 
    ASSESSMENT CRITERION RANGE 
  • Types of maintenance include, but are not limited to, day-to-day maintenance, minor and major maintenance projects.
  • Procedures include, but are not limited to, verbal quotes, written quotes, informal tenders and formal tenders.
     

  • ASSESSMENT CRITERION 3 
    The need to maintain school buildings and grounds are explained in terms of keeping them in optimal condition to aid school activities and effective use of funds. 
    ASSESSMENT CRITERION RANGE 
    Optimal condition includes but is not limited to visual and emotional impact, safe environment, lower maintenance cost, access control.
     

    ASSESSMENT CRITERION 4 
    The reason and principles for preventative maintenance procedures are explained using relevant examples. 

    ASSESSMENT CRITERION 5 
    The selection, use, maintenance and safe and secure storing of equipment, machinery and tools are explained to ensure correct use and care in order to save costs. 

    ASSESSMENT CRITERION 6 
    An annual maintenance schedule is developed or planned so that maintenance is conducted regularly and linked to budgets. 
    ASSESSMENT CRITERION RANGE 
    Plans include but are not limited to short term plans, long term plans, and regular maintenance tasks.

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    The provincial policy and process with regard to the letting of school grounds and buildings is explained to aid compliance to them. 

    ASSESSMENT CRITERION 2 
    The clauses that a lease must include to ensure protection for the lessor and the state or land-owner are listed and explained in relation to the legal responsibilities of the SGB in this regard. 
    ASSESSMENT CRITERION RANGE 
    Clauses include lease term, expiry or renewal date, rental amount, payment dates, conditions and termination of lease, maintenance, cleaning, use of water and/or electricity, dispute resolution.
     

    ASSESSMENT CRITERION 3 
    All documentation that must be kept by the school with regard to the letting of immovable school property is listed and the reason for each is explained. 
    ASSESSMENT CRITERION RANGE 
    Documentation includes, but is not limited to, SGB meeting minutes, offer from the lessee, approval, lease agreement, proof of payments.
     

    SPECIFIC OUTCOME 4 
    Apply knowledge of procurement and administration of movable and immovable assets in a school.

    ASSESSMENT CRITERION 1 
    The concept of movable and immovable enable the classification of school assets. 

    ASSESSMENT CRITERION 2 
    The accountability of the school management team to the SGB is explained in terms of the responsibility of the SGB regarding assets. 

    ASSESSMENT CRITERION 3 
    The procedures for managing thefts and acts of vandalism that destroy school property are prepared and applied. 

    ASSESSMENT CRITERION 4 
    The monitoring and administration of a lease are explained to ensure that correct procedures are followed and that parties comply with the terms thereof. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • Anyone assessing a learner or moderating the assessment of a learner against this Unit Standard must be registered as an assessor with the relevant ETQA.
  • Any institution offering learning that will enable the achievement of this Unit Standard must be accredited as a provider with the relevant ETQA.
  • Assessment and moderation of assessment will be overseen by the relevant ETQA according to the ETQA policies and guidelines for assessment and moderation.
  • Moderation must include both internal and external moderation of assessments at exit points of the qualification, unless ETQA policies specify otherwise. Moderation should also encompass achievement of the competence described both in individual Unit Standards as well as the integrated competence described in the qualification.
