PURPOSE OF THE UNIT STANDARD 
This unit standard will enable court-based learners to understand the family law environment, fostering a professional environment for the delivery of family law services and strengthening the relationship between communities and the justice system.

Learners credited with this unit standard will be able to:
  • Facilitate service to people with low levels of literacy and numeracy in family law.
  • Apply the charter of victim services and the principles of minimum standards in relation to family law.
  • Analyse which social security grants are available in South Africa and refer people to access points.
  • Facilitate meetings with people involved in family disputes.

    UNIT STANDARD RANGE 
    This unit standard focuses specifically on the interaction between court-based staff providing family law-related services and members of the public seeking assistance from the court. 

    Specific Outcomes and Assessment Criteria: 

    SPECIFIC OUTCOME 1 
    Facilitate service to people with low levels of literacy and numeracy in family law. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    Forms used in family law matters are explained to court users in terms of their purpose and content. 
    ASSESSMENT CRITERION RANGE 
    Forms must include those most commonly used in family law-related matters. Range to include more complex forms (such as applications for protection orders, combined summons and particulars of claim) as well as simpler forms (for example, maintenance consent papers).
     

    ASSESSMENT CRITERION 2 
    Forms are classified with reference to the legal needs of court users. 
    ASSESSMENT CRITERION RANGE 
    Forms must include those most commonly used in maintenance, domestic violence, children's court and divorce matters.

    The role of household budgets in family law proceedings is examined in order to inform court users.

    OUTCOME RANGE 
    This learning outcome must cover the family law specific provisions contained in the Department of Justice's charter of victim services and the principles of minimum standards in service delivery. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    The charter of victim services and minimum standards in service delivery are analysed in the context of family law. 

    ASSESSMENT CRITERION 2 
    Sections of the charter of victim services are reviewed with reference to family law matters. 

    ASSESSMENT CRITERION 3 
    Principles of minimum standards are examined with reference to family law matters. 

    ASSESSMENT CRITERION 4 
    Work practices capable of adjustment are evaluated in order to support the charter and the principles of minimum standards in family law. 

    SPECIFIC OUTCOME 3 
    Analyse which social security grants available in South Africa and refer people to access points. 
    OUTCOME RANGE 
    Social security grants must include the state old age grant, the child maintenance grant, the foster care grant, the care dependency grant and the disability grant. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    The nature, scope, eligibility requirements and monetary value of the various social security grants in South Africa are analysed in the context of family law. 

    ASSESSMENT CRITERION 2 
    Members of the public are assisted to identify which grant(s) they may be eligible for. 

    ASSESSMENT CRITERION 3 
    Members of the public are advised on the documentation needed to apply for grants. 

    ASSESSMENT CRITERION 4 
    A contact list is compiled and updated of social development offices and or other access points to apply for social grants. 

    SPECIFIC OUTCOME 4 
    Facilitate meetings with people involved in family disputes.

    The purpose and procedure of family dispute meetings are examined in order to inform court users. 

    ASSESSMENT CRITERION 2 
    The role of the facilitator is debated with reference to family law meetings. 

    ASSESSMENT CRITERION 3 
    Meetings are facilitated to ensure the active participation of all parties in role play. 

    ASSESSMENT CRITERION 4 
    Disruptive and or difficult behaviour by a party to a meeting is dealt with in order to facilitate the progress of the meeting. 

    ASSESSMENT CRITERION 5 
    The outcomes of a meeting are summarised and the legal process ahead is described to the parties. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • An individual wishing to be assessed (including through RPL) against this Unit Standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA, or an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Anyone assessing a learner against this Unit Standard must be registered as an assessor with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Any institution offering learning that will enable achievement of this Unit Standard or assessing this Unit Standard must be accredited as a provider with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Moderation of assessment will be conducted by the relevant ETQA at its discretion.
