PURPOSE OF THE UNIT STANDARD 
Learners who have achieved this unit standard are capable of conducting a lawful search and seizure.

A person credited with this unit standard will be able to:
  • Stop and search a vehicle
  • Search a person
  • Search a premises
  • Seize property for future purposes of evidence

    This unit standard will contribute to the full development of any learner within the safety in society environment and more specifically within the policing discipline by providing recognition, further mobility and transportability within the field. The skills, knowledge and understanding demonstrated within this unit standard are essential for social and economic transformation and upliftment within the safety in society environment.

    1. Suspect vehicle is identified and stopped to confirm the suspicion according to organizational procedures.

    3. Description of vehicle is given and noted according to organizational procedures.

    1. The circumstances under which the search of premises is explained as stipulated in the Constitution and according to relevant legislation.

    2. The provisions under which a person may enter or search a premises are explained regarding the use of force according to relevant legislation. 

    ASSESSMENT CRITERION 3 
    3. The legal requirements for the search of a premises with and without a warrant is explained and demonstrated according to the Criminal Procedure Act. 

    ASSESSMENT CRITERION 4 
    4. The legal rights of a person on the premises is explained and enforced when searching a premises according to the Constitution, chapter 2, Bill of rights.

    ASSESSMENT CRITERION 1 
    1. The circumstances under which the evidence may be seized are explained as stipulated in the Constitution and other relevant Legislation. 

    ASSESSMENT CRITERION 2 
    2. The provisions under which a person may seize property for future purposes of evidence are explained according to relevant legislation. 

    ASSESSMENT CRITERION 3 
    3. The way of conducting a legal seize is demonstrated according to the criminal procedure act and organizational procedures. 

    ASSESSMENT CRITERION 4 
    4. The legal implications of not adhering to the requirements while conducting a seizure is explain as set out in the criminal procedure act and the constitution and organizational orders. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
    1. Moderation of assessment will be overseen by the relevant ETQA according to the moderation guidelines in the relevant qualification and the agreed ETQA procedures
    2. Candidates are assessed against these assessment criteria. An assessor observes currently employed candidates carrying out their normal work duties. They may also be asked to carry out simulated tasks and to answer written and/or oral questions. Candidates studying towards a Unit Standard, and who are not currently employed, will also be assessed using variety of assessment tools
    3. Anyone assessing a learner against this unit standard must be registered as an assessor with the relevant ETQA
    4. Any institution offering learning that will enable achievement of this unit standard must be accredited as a provider through the relevant ETQA by SAQA.

    The standard describes competent performance in conducting a lawful search and seizure, and lay down the criteria by which competence should be judged, as well as the range of circumstances in which competence should be demonstrated.

    Integrated assessment methods and tools will allow the candidate to demonstrate that she/he has acquired knowledge of and can safely and effectively apply competence identified in this unit standard.

    These tools include the following:
    o In-situ (on-the-job) observations
    o Role-play simulations
    o Structured group discussions
    o Written reports (e.g. tests, exams, case studies, projects, registers, logbooks, workbooks)
    o Verbal report backs (presentations)
    o Portfolios of evidence
    o Projects (physical visits to Government Departments)
    o Experiential learning
    o Working in teams
    o Scenario sketching

    These methods must be carefully selected based on the purpose of the assessment (For example, the written method of assessing knowledge or on-job demonstration of practical competence). The assessment must integrate a number of different methods in order to give the assessor reliable and valid proof of competence and evidence of required attitudes.
