PURPOSE OF THE UNIT STANDARD 
This unit standard is intended for learners in insurance, government, carriers of workers' compensation, human resource practitioners, health and safety officers, safety officers, safety representatives and shop stewards and others involved in the application of the Act.

The qualifying learner is capable of:
  • Explaining the purpose of COIDA.
  • Explaining negligence as it is used in the Act.
  • Describing the avenues available to an employee or his/her dependents if they are dissatisfied with an award.
  • Analysing situations covered by COIDA where the accident or occupational disease does not arise out of and in the course of employment. 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    There is open access to this Unit Standard. Learners should be competent in Communication, Mathematical and Financial Literacy at NQF Level 3. 

    UNIT STANDARD RANGE 
    The typical scope of this unit standard is:
    1. Situations covered by COIDA that are not necessarily out of or in the course of employment include transport, rendering first aid, emergency situations and performing emergency work.
    2. Incidents or accidents include diseases, training situations, occupational health and safety risks.

    SPECIFIC OUTCOME 1 
    Explain the purpose of COIDA. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Reasons for the Act are explained with reference to the responsibility of the State to employees in the open labour market. 

    ASSESSMENT CRITERION 2 
    Legislation that regulates health and safety in the workplace is named and an indication is given of the Government Ministry responsible for workplace health and safety. 

    ASSESSMENT CRITERION 3 
    The implications of the same Ministry being responsible for both workplace safety and worker compensation are explained in terms of control. 

    ASSESSMENT CRITERION 4 
    The concept of compensation is explained with reference to its components and uses. 

    ASSESSMENT CRITERION 5 
    The concept of the Reserve Fund is explained with reference to its components and uses. 

    ASSESSMENT CRITERION 6 
    The role of COIDA in preventing litigation at common law between employer and employee is explained with reference to the right to compensation for accidents and occupational diseases incurred on duty. 

    SPECIFIC OUTCOME 2 
    Explain negligence as used in the Act. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Acts or omissions on the part of the employer that are regarded as negligence are analysed in four case studies. 

    ASSESSMENT CRITERION 2 
    The effect of negligence on the part of the employer is explained in terms of the employee's right to compensation. 

    ASSESSMENT CRITERION 3 
    The effect of negligence or serious and willful misconduct on the part of the employee is explained with reference to his/her right to compensation. 

    ASSESSMENT CRITERION 4 
    Reporting procedures required by the Act are outlined and an indication is given of the consequences of non-compliance. 

    SPECIFIC OUTCOME 3 
    Describe the avenues available to an employee and his/her dependents if they are dissatisfied with an award. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    The roles of the Director General and Compensation Commissioner in adjudicating an award are explained with examples. 

    ASSESSMENT CRITERION 2 
    The concept of an objection as used in COIDA is explained and an indication is given of the process to be followed in the case of an objection. 

    ASSESSMENT CRITERION 3 
    The process that may be followed if an objection is unsuccessful is explained and situations are identified in which a case may be successful in court. 

    ASSESSMENT CRITERION 4 
    Situations where cases may be reopened are identified and an indication is given of the evidence required to motivate the reopening of a case. 

    SPECIFIC OUTCOME 4 
    Analyse situations covered by COIDA where the accident or occupational disease does not arise out of and in the course of employment.

    ASSESSMENT CRITERION 1 
    Incidents or accidents involving employees are analysed to determine whether or not they are covered by COIDA. 

    ASSESSMENT CRITERION 2 
    Situations that are covered by COIDA and are not necessarily out of or in the course of employment are analysed for five case studies.
